2. Purpose

This Legal Notice governs access to, navigation through and use of the website and of the services offered by VIAJEENMARRUECOS S.A.R.L., whether through the website, other digital channels (email, WhatsApp, social media) or our physical offices, in connection with our activity of organizing and managing trips in Morocco.

3. Terms of use

Access to the website and/or contracting our services implies the express and unreserved acceptance of this Legal Notice. The user undertakes to use the services in a responsible, lawful and good-faith manner.

The following is expressly prohibited:

  • Using the services for unlawful, fraudulent or otherwise non-compliant purposes.
  • Spreading false information that could harm the reputation of the company or third parties.
  • Reverse engineering, mass scraping or any unauthorized attempt to access our systems.
  • Infringing the intellectual or industrial property rights described in section 4.

4. Intellectual and industrial property · Registered trademark

All content on this website — including text, images, photographs, videos, illustrations, logos, designs, software, databases, source code, layout and any other material — is protected by intellectual and industrial property rights owned by VIAJEENMARRUECOS S.A.R.L. or by third parties who have expressly authorized its use.

The trade name "Viaje en Marruecos", its logo and the associated distinctive elements are registered as a trademark with:

  • OMPIC — Moroccan Office of Industrial and Commercial Property (Office Marocain de la Propriété Industrielle et Commerciale)
  • WIPO — World Intellectual Property Organization
  • Registration number: 294998

It is strictly forbidden to reproduce, distribute, modify, transform, publicly communicate or commercially exploit, in whole or in part, the protected content or the trademark without the prior, express, written authorization of VIAJEENMARRUECOS S.A.R.L. Any unauthorized use will be subject to the corresponding legal action under Moroccan and international jurisdiction.

5. Warning about fraudulent agencies and similar names

VIAJEENMARRUECOS S.A.R.L. informs its clients and the general public that there are individuals and websites using names, logos or domains similar to our brand, without authorization or any connection to this company.

To avoid fraud, identity theft or confusion, please note that:

Any communication, quote, contract or payment that does not come through the official channels listed above is not the responsibility of this company. If you have any doubt about the authenticity of a communication, please contact us directly through the official channels before making any payment.

The fraudulent use of our trademark, name or distinctive elements will be reported to the competent Moroccan and international authorities under Law 17-97 on the Protection of Industrial Property and the Paris Convention.

6. Liability, medical insurance and risk activities

VIAJEENMARRUECOS S.A.R.L. expressly informs its clients that the tourist packages do not include travel insurance, accident insurance or medical expense insurance. Each client is responsible for purchasing, at their own expense and under their own responsibility, a travel and medical assistance insurance policy with adequate coverage for Morocco before starting any activity.

The company is not liable for any medical expense, accident, injury, illness, loss or damage that may arise during the activities included in the packages, including but not limited to:

  • Camel / dromedary rides
  • 4x4 / jeep excursions
  • Quad bikes (ATVs), buggies and similar motorized vehicles
  • Sandboarding and adventure sports on the dunes
  • Hiking and trekking
  • Hot-air balloon rides
  • Any other activity considered adventurous or risky

By booking the services, the client expressly declares that they participate in these activities at their own risk and responsibility, and releases the company from any claim arising from them.

7. Cookies policy

The site uses strictly necessary technical cookies for session management, language persistence and payment security. These cookies do not require consent under applicable regulations. We do not use advertising tracking cookies and we do not sell information to third parties for commercial purposes.

8. Third-party links

The website may contain links to external sites (social media, suppliers, hotels, airlines, etc.). VIAJEENMARRUECOS S.A.R.L. is not responsible for the content, privacy practices or availability of those sites. Access to such links is at the user's sole responsibility.

9. Personal data protection (Privacy Notice)

In accordance with Moroccan law (Law 09-08 on the protection of natural persons with regard to the processing of personal data) and applicable international rules (including the European Union General Data Protection Regulation — GDPR, where applicable), personal data collected through forms, emails, WhatsApp or any other channel will be processed confidentially by VIAJEENMARRUECOS S.A.R.L. for the following purposes:

  • Managing bookings, payments and contracted services.
  • Providing information related to the trips, activities and experiences.
  • Complying with legal, tax and administrative obligations (including the submission of passenger lists to the authorities when required).
  • Maintaining communication with current and prospective clients throughout the booking process.
  • Improving service quality and preventing fraud.

The user may exercise their rights of access, rectification, deletion, opposition, restriction and portability by sending a written request to info@viajeenmarruecos.com with "Personal data" in the subject line.

Data will not be transferred to third parties, except in the following cases:

  • Legal obligation (migratory, tax or judicial authorities).
  • When necessary for the correct delivery of the contracted service (hotels, airlines, carriers and local guides who require guest information).
  • Technical providers essential to the operation of the service (Stripe payment processor, Resend email provider, Vercel hosting and Supabase database), all of whom maintain their own confidentiality guarantees.

10. Payment methods and booking terms

  • Group packages: require a deposit between €100 and €400 per person, depending on the package and the accommodation category. The balance is paid on arrival in Morocco in cash (EUR) or by card (with a 5% surcharge).
  • Private trips: require a 50% advance payment of the total trip price to confirm the booking and secure the accommodations. The remaining 50% must be paid at least 15 days before the arrival date. Payments can be made by card (Stripe), bank transfer, PayPal or other previously agreed means.
  • Extra nights and additional services: are charged together with the deposit so the room can be reserved in advance.

Cancellation and refund conditions

  • Group trips: the deposit is non-refundable. Date changes may be requested without penalty by giving at least 7 days' notice before the original arrival date.
  • Private trips: date changes may be requested with at least 20 days' notice before the original date. Price adjustments may apply depending on the new date, availability and accommodation category.
  • Cancellations for exceptional reasons: will be assessed on a case-by-case basis, respecting the conditions of underlying suppliers (airlines, hotels, etc.).

11. Force majeure

VIAJEENMARRUECOS S.A.R.L. will not be liable for failure or delay in performing services due to force majeure, including without limitation: natural disasters, extreme weather, strikes, social unrest, government restrictions, pandemics or epidemics, third-party flight cancellations or delays, or any other event beyond the company's reasonable control.

In such cases, the company will endeavor to reorganize the services, offer equivalent alternatives or postpone the trip to a later date, without the client being entitled to additional compensation.

12. Modification of services

The company reserves the right to modify elements of the itinerary (timings, hotels, transport or order of visits) when operational, safety or force majeure reasons make it advisable, without this constituting a breach of contract as long as the equivalent quality of the contracted service is maintained.

13. Acceptance of terms

By booking a trip, completing a form or making a payment to VIAJEENMARRUECOS S.A.R.L., the client declares that they have read, understood and expressly accepted all the terms contained in this Legal Notice, Privacy Policy and Booking Terms.

14. Mediation and dispute resolution

In the event of any disagreement with a service, the client may send a written complaint to info@viajeenmarruecos.com. The company undertakes to respond within a maximum of 15 business days and to seek an amicable solution.

15. Applicable law and jurisdiction

This Legal Notice is governed by the laws in force in the Kingdom of Morocco. For any dispute arising from the interpretation or execution of this Notice, the parties expressly submit to the jurisdiction of the competent courts of Marrakech, expressly waiving any other jurisdiction that might apply to them.
